Yes you can apply for EAD and AP separetly anytime
The only catch I found out recently is that when you use AP to travel back to US, this may invalidate the H visa and you will need EAD.
I am still not clear of this issue. I applied for EAD few months ago and found out this may be an issue , so have applied for AP (By e-filing) now
Using AP to travel does not invalidate the H1...AP is just a travel document, and does not determine one's status in the country. The H1 would be invalidated only if the person switches to EAD.

Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-)
Don't know its good or bad. Any idea anyone?

Hi people, I am currently applying change of status from H1 to F1. Since my PERM got audit, and my h1 visa is going to expire in the end of January 2009, I need to change my status to F1 student visa in order to stay in the U.S legally. Now, I am trying to fill out the form I-539 by myself, and I got confused on:
part 4. additional information on 3g:"Have you, or any other person included in this application, been employed in the U.S. since last admitted or granted an extension or change of status?"
I don't know should I put "YES" or "NO", I have never done "i-539 for change of status" on my first F1/OPT to H1 visa....but I actually worked in the U.S...
Can anyone help me to answer that? Thanks a lot!!!

Hi,
On the USCIS website, it mentioned "normal processing time" in the following statement. I am wondering what is the normal processing time for I-485. I can't find it. When the published processing time is current for a case, how long it will take for a case to be approved?
My case suddenly becomes current for a month with the sudden forward movement of the processing time. I am wondering how long should I wait before I contact USCIS about my case if I do not hear anything from them.
When is name check initiated? When the case is received or when the case processing time becomes current?
