It depends on your Service Center. For TSC, you can have your EAD after 11 weeks from Receipt. For NSC, you can have your EAD after 12 to 14 weeks from Receipt.

Hello All,
I need your advice. My H1B for first 3 years is expiring in Sep 09. I am a consultant and my project is till June 09. So I will be on bench after that till I get a new project. So if I have to file for extension should i file it now when I am in project or should i wait.
When I asked my employer about filing extension, they told that they are getting lot of queries these days. They even told be if my project is getting over early then its difficult to get an approved extension as these days they even have to send the contract letter of clients which do states that when my project is going to end.
So i need to know what are my options.
When Should I file for extension and is there any other options.

Some where I read that there is no fee for renewal of AP. I am a Jul 07 filer and am not sure about this. Further already applied last year for Advance parole and traveled once. it got expired last month. I am applying for a new one again. So just wanted to know if I need to pay the fees $305.
So my questions are:
Does July 07 filers need to send the cheque for $305 for AP renewal. (My I 485 Reciept Date is Aug 2007)
Should we also include Biometric fee of $80?
And how much time approx is it taking these days for AP?

I am in the same boat. Filed July 19th . As of Last Friday not in the system.
No checks cleared. All the guys who filed with me got their receipt last week from Texas. I am the only one remaining. My I140 was approved from NSC.

Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.
