There should not be any issues changing the employer after 180 days. This would include proper way of resigning the company so that they don't do anything which will affect your green card.

My wife is planning to start MS on H4 visa next month. Her Visa is valid till Oct 2009, my H1 and H4 are renewed till OCt 2012 (no visa stamp yet.)
Before she starts going to school on H4 visa, do we need to inform USCIS or take any permission from them ?

My birth was regiestered under totally different first name, also DOB is off by 9 days (10th June instead of 1st June). Since the birth is registered they are not issueing non-availability cert. . What to do?
I have both parents affidavits, school leaving cert, 10th class cert, PAN card showing date/place same as that in passport. Filing a civil case in India is the option but it could take more than a year. since my PD is Sep04, my 485 could be processed within months.

I guess it is possible but if your H1 transfer was approved then you might have to apply for another transfer.
No, you don't have to apply for a new H1 if the previous company did cancel your H1 and the H1 has not expired. A dormant H1 can be reactivated at any time.

have u seen the legal immigration/ foriegn workers issue address by Bush today. althou he spoke just 1-2 sentences. stating that ' legal immigration system needs to be fixed, so that foriegn workers are in no harm
Bush did not mention a single word about legal immigration. He was referring to foreign (limit/read that as Mexican) workers and putting in place programs to stem the flow of additional undocumented ones. He spoke just over a minute and there was not a bit to be gleeful about for legal immigrants.

These tough times for folks like me have been there for the past several years. Now, I am hoping the letters campaign does make an impact and get the much required good will.
As a side note, seems like the writers have sort of given up already on his last year of his presidency as the entire speech was rather mundane. In a troubled time for the entire country with the economy down, house market bust, recession looming, he chose to highlight the past and glorify to garner legacy.
Will it be a year of inaction? I hope not, lets us do our bit by supporting efforts of IV.

I-485 Filed Jul'07
Please help me with:
1) Assuming 140 is approved before changing the current job under AC21, what are the things the new firm has to file. Does the new firm have to file 140 again? I presume that labor and 485 stays intact..pl help folks.
2) I will complete 6 mths of 485 filing in Jan-08. If 140 gets approved around Jan-Feb'08, is there any risk if I change my employer after that under Ac21. Does it hurt if the present firm withdraws 140 after approval?

You can stay here as long as the I797 is valid (there is no rule to stamp it within a year). Do you have H1B stamped frome before or is this your first H1? If the first one then you have to get it stamped when you travel out of US. If this is not the first one then you can travel back on your old H1 stamp with new I797.

Here is my situation:
I was joined as a contractor at CLIENT through client's preferred VENDOR. My paystub runs by my EMPLOYER. I use to submit my timesheets to my EMPLOYER and VENDOR every week. My EMPLOYER runs my paystub everymonth with minimum pay amount and not as per actual earnings. For ex:my actuals were $9500/- per month, he rans for only $6000/- every month. This gap is because he says he didn't receive the payments from VENDOR. With these gaps everymonth the dues between my employer and me has increased a lot, and my employer has to pay to me some $xx thousands dollars. There is no document/written evidence with me from my employer. My employer always tells me on phone, how much they paid to me and how much of mine they are holding.
After my contract completion(for ex:10/30/09) at CLIENT, I joined and started as a Full Time Salaried employee at CLIENT on 11/5/2009. I submitted my resignation to my previous EMPLOYER on 11/16/2009.
I have to collect my dues(ex: $xx thousands) from previous EMPLOYER. How can I proceed further to collect these dues, as there is no document / written evidence with me from him. My previous employer always communicate with me on phone to update the money transactions.
My current visa status is, I am a Green Card holder.
Please help me how to proceed in collecting my dues from my previous employer.

USCIS received my application on May 7th and my wife's application on May12th. USCIS posted both checks at the same time and both hit my account on May 21st. Received receipt notice on May 24th. I think USCIS waits for a couplle of weeks and then processes all applications at the same time - hence a delay - or a log of 2 -3 weeks.
It was an all papaer application.
