Thank you. I agree with you 100%.
Did you or someone you know experience such questions at POE for an advanced parole? Or are you just posing a hypothetical?
I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.
What is the point of having an early 485 filed, if you are not going to use EAD and AP and be at mercy of consulates for restamping and be at mercy of employers who will need to sponsor you to hire you?

We didn't hear back from you. Please let us know the information you got from USCIS. Here lot of people waiting for your post (Prabably GOODNEWS from you).
I read many places that you can attach case approval status if you have receipt number. USCIS will verify the beneficiary and will port priority date. Has anybody verified with attorney?

No offense to anyone, you are still free to discuss anything you want.
The purpose of this thread was to get information from the immigration point of view and wether its ok to start your company if you have 485 pending and what effect it might have on your GC process and also to get valuable information from people who have already started their own company.
Guys Please post valuable information on this thread, so that it can help other people who are planning to start their own company.

US does not discriminate on the basis of Race, Caste, Religion though their is no mention of country of birth. But discriminating Green Card quota on basis of somebody's birth may be unconstitutional..If we appeal in the supreme court, the supreme court can ask the congress to ammend the laws...google and see there have been several instances in the history when Supreme Court told the congress to change a illegal law.
here's the google link of my searches

What part of Canada did you move to?
I am from India and I have worked in the USA for the last 6 years. I have immigrated to Canada with a Job 6 months back to avoid overystaying. My experience in Canada is very bad. I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.

well, let me add my story but it is the same as others..
Hubby has already achieved the maximum in his position and would most probably have to pass any promotion opportunities, so his problem with the whole GC process is that he has to stay with current employer and continue to suffer professionally.
My problem is just like the guy's story few posts above. I have all teaching credentials and 3 years of teaching exp from my home country as well as US teaching License. Jobs are coming my way all the time, (my credential is from a shortage subject area), but H1 doors had closed forever due to the USCIS interpretation of the famous time issue for H1 & H4 visa holders.
When I got a job offer, by the time County HR made official offer, H1 quota ran out for that fiscal year. The same thing happened two more times. Oh, I forgot to add how I have been following my spouse over the country for all of his projects...
Then I read about people who actually change their mind and do not want to utilize their H1 after all!
Ha...!!
Even taking up a teaching job on J1 visa is closed to me...
Am I angry? You bet I am...
Not even an EAD in sight for another 7 years. Well, I am not going to sit around much longer. Just got word that it will take 60 days to transfer my US teaching License to Ontario and jobs are plentiful for someone with my content area as well.
As soon as I finish my Masters Degree I am off to Canada. :D :D Don't care for US or green card any more!

There is a saying in accounting world "Figures dont lie, liars will figure it out." We keep on doing the same thing. Try to make numbers that look good. The truth is the dates for India And china cannot and will not move until some legislative changes are made. The legislative changes will only happen when we all get united and ask for those changes aloud. The key to success is unity and joint participation.

I agree with va_dude.
CIR will cater for a larger audience and as such it will most likely generate greater emotional response and debate. Also, given the current economic climate, "Employment Based" is not the most favorable buzz word for anyone on Capitol Hill.
We have to keep in mind that unemployment might still not improve until second quarter of next year and if the CIR is brought up this year, "Employment Based" bits in the bill are not going to get a lot of support.
In the end, the CIR may or may not even pass. So if we shoot for just one target and miss it, we lose our opportunity for this year.
If this "family bill" has been introduced which surely does not go all the way, but still indirectly goes a long, long way in alleviating the current EB problems, why not back it? This bill too may not go anywhere but the support it generates might help in the end so that some provisions might even get included in the CIR. Also, given that it is termed as a "family bill", it might generate less resistance and in the end we might have a better chance of seeing it through.
In the past both bills have been introduced and gone nowhere so it's better to try and shoot for both and hope that one hits or at least support for one has a favorable impact on the other.
I think fighting for little bites rather than for one big piece of pie might see us through or at least help bring relief to some, albeit slower than we would like but relief nonetheless.
I'm sure the IV Core knows more than I do and I just wish to point out that we should pick our fights wisely.

I am suprprised if IV is working towards abiltiy to file 485 and hard country limit...Just want to know how IV is working towards these 2 items...
If any of these two wont show out in coming bill,..then I would say goodbye to IV..because all other items in bill were there without IV;s interaction....
Can somebody calrify if these options will anyway include in this bill..by means of ammendements...
This is like someone in Sri Lanka saying that "if I don't get a blanket within 12 hours of the Tsunami, I will quit the Red Cross."
How about thinking, "if these items don't show up in the coming bill, I will become a more active member and work towards getting these items to show up at the next opportunity"?
It is probably not a good idea to treat our voluntary organization as if it were our butler. We're all part of this; we didn't "hire" IV to do this job for us.

Hi bitzbytz,
How much are you paying and for how many paystubs? Are you planning to go out of country for stamping? I am in a similar situation.
Did you got the visa stamping dates?
Thanks
what do you mean by fake pay stubs, can you please clarify.
I am in process of generating pay stubs for my wife by paying the employer tax...so that she is covered for the un paid H1 period.
Why will this cause problem

people we are coming close to the situation where it is "do or get fried :)".
I disagree that the situation is very bad.
It is bad only for those that are laid off on H1B. All others have EAD and are happy. They will realize the bad situation only when they cannot take a promotion or salary raise or cannot change job due to same and similar. Or if I485 gets an RFE or denial.
If the situation was bad, more people would be serious about your idea including you. Even you are not willing to do anything yourself other than asking others to do it. So this is the fate of immigrant community. We all do not want to do anything ourselves unless we ourseves are in a bad situation.

Ok, now that you have negated all ideas from other people, we anxiously wait for your ideas :)
I am sure you are not just some reactive person who can only criticize but can also provide us with a solution.
Lets hear em.
This is easy, practical and may be more effective.
Co-ordinate working round-the-clock (24 hours non-stop) wherever, in whatever organization/immigation community is working.Let it be coast-to-coast. let the work start as usual on friday morning at 8am and end at 8.am on saturday. Employers will be happy and we can win enormous support. Send simultaneous cards to uscis/law makers.

In EAD form, they are asking about previous EAD info..like which service center, what date, GRANTED or REJECTEd etc.. Now I had two EADs..one is OPT and other one I got last year. Do I have to write info for both one or just for last year?? In last year's form, I wrote info about my OPT. But what now?

IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).
This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.
Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.
Bottomline, do not underestimate America. They know what they do.
You are right they know what they do but it will be beneficial for US economy only. In terms to USD to INR, we will lose. Check the history and present.
In case of Japan, Yen was fixed to 360 Y to 1 $ in 1949.
By 1971 the yen had become undervalued. Japanese exports were costing too little in international markets, and imports from abroad were costing the Japanese too much. This undervaluation was reflected in the current account balance, which had risen from the deficits of the early 1960s to a then-large surplus of U.S. $5.8 billion in 1971. The belief that the yen, and several other major currencies, were undervalued motivated the United States' actions in 1971.
Following the United States' measures to devalue the dollar in the summer of 1971, the Japanese government agreed to a new, fixed exchange rate as part of the Smithsonian Agreement, signed at the end of the year. This agreement set the exchange rate at 308 per US$1.
In 1985 a dramatic change began. Finance officials from major nations signed an agreement (the Plaza Accord) affirming that the dollar was overvalued (and, therefore, the yen undervalued). This agreement, and shifting supply and demand pressures in the markets, led to a rapid rise in the value of the yen. From its average of 239 per US$1 in 1985, the yen rose to a peak of 128 in 1988, virtually doubling its value relative to the dollar. After declining somewhat in 1989 and 1990, it reached a new high of 123 to US$1 in December 1992. In April 1995, the yen hit a peak of under 80 yen per dollar, temporarily making Japan's economy nearly the size of the US.
This way both US and Japan economies are stabilized now but Yen value became high from 360 to 115 per dollar now.
It is happening with China also. Us is pressing China to raise the value of Yuan and devalue dollar against Yuan so US exports can be cheaper in China and Chinese exports can be expensive in US.
Future is India. After too much of outsourcing, INR will raise again USD and my guestimate is 1 USD to 20 INR after 10 years.
Time to convert all savings in INR.
