- copy of 485 receipt
- front and back of current EAD card
- 2 photos (make sure to write A# and name at the back using a pencil)
- check payable to US department of homeland security

I think we need to wait for 90 days from the date they generated the recipt, then go to USCIS.
Did any one go there after 90 days of receipt date and still get no response from them?

If AOS takes many years, then keep the non-immigrant visa, so that no need to worry about AP.
You are suggesting how to avoid it rather then try to acknowledge that there is a problem in the wording of AP. By problem, I meant the whole dynamics has changes over the years, so, its time they change to reflect today's reality.
There may not be everyone who would continue to be on H1 while their AOS is pending.

From the same memorandum:
"Accordingly, if the employer withdraws the approved Form I-140 on or after the date that the Form I-485 has been pending 180 days, the approved Form I-140 shall remain valid under the provisions of �106(c) of AC21. Days when President started talking about fighting to make sure the immigration bill be passed, I felt even people who are here legally should get a fair chance. Not that it is a competetion for immigration, but its playing a fair game.
The immigration bill if passed, will come and stop at the same place where everyone of us are in now or even worse and pulls the whole system down.
I'm glad to see such a thing like immigration voice. This will make the law makers think with a broader mind.

this is my 10th year in the US & never had a single incident along the racial lines.. probably I lucked out.. However, I don't subscribe to this opinion of removing moustache..... I am proud of my bushy moustache & have had women admire that at/outside work.. But I do agree 100% on all the other points you raised..

Do you think its going to be any problem from changing Full time to Contractor?
AC21 letter - wording is very important - the offer MUST be Permanant fulltime and the prospects for future employment must also be good - this is exactly what they request in a RFE or a NOID.
If your letter says it is temporary position, you will have issues.

It is better to make two trips and do a civil wedding i know it is expensive imagine if she has a work permit u can make up for the cost in no time else she will not be able to work for many many years.
I am in a similar situation getting married in Sep07 and returning with my wife at end of Sep'07. It is little scary, as some say it might be risky not to apply along with the spouse.

04/28/2007: Sen. Hagel's Immigrant Accountability Act of 2007, S.1225, and Point System for Legalization
The Senater has released the skeleton of this bill that provides for legalization of illegal aliens as part of his Comprehensive Immigration Reform legislation proposal. This is a companion bill to his High-Tech Worker relief proposal. Supposedly, S. 1225 is to cover the illegal immigration issues and the High-Tech worker relief bill is to cover the legal immigration issues.
It is uncertain the point system the House Judiciary Subcommittee is scheduled to have a hearing on 05/03/2007 is limited to the legalization legislation or overhaul of the total immigration system. If it is limited to the legalization, we would not necessarily oppose to the idea, but it involves overhaul of the entire immigration systemn, we would strongly oppose to such point system.
The point system which Senator explained in the press release in S. 1225 includes the following:
� Military Service (after meeting initial qualifications for adjustment)
� Advanced English proficiency
. Civic Engagement � significant community service work (religious or secular), a clean criminal record, and on time payment of income taxes for past work
� Business ownership (which employs at least 2 unrelated �legal� workers)
� Home ownership
� Work History (points for each year of work an alien can prove) (Like Hagel/Martinez)
� Education (additional points for all levels of education)
� U.S. Presence (points for length of time in the U.S.) (Like Hagel/Martinez)
� U.S. Citizen/Permanent Resident Spouse or minor child
(A)Basic Points FACTOR POSSIBLE POINTS
Work :The range of points is based on the number of years a person has worked in the U.S. (Up to 5 points per year possible.) 15-30
Education :An alien may earn minimal points for primary school, additional points for high school or obtaining a GED, or skilled trade license. 15-30

Folks,
I've been hearing a lot of banter about the L1 Vs H1-B the fact remains both these categories are badly abused, it doesnt matter who is the bigger evil. I would tend to agree that L1 has a worse abuse rate however.

When the H1-B was conceived it was supposed to pave its way really skilled engineers with excellent credentials and it is not the case anymore, 1)if you are going to tell me things like QA and Data Warehousing need mind boggling skills I think I can just have a good laugh at it. The local citizens are very much capable of executing on them. These jobs account for a huge majority of the software based jobs in the US, yes this is not the only category for H1-B jobs but software accounts for a big chunk.

2) Consultants bringing in people from wherever charging them a huge sum of money filing for their H1-B and then looking out for a job for them, the only skill here is the consultants skill in finding the person a job :-).

3) I do not agree with the notion of good consultants, every consultant abuses the employment based Visa system,
4) and I am for a cap on L1-B visa's or a limit thats decided by the number of employees a firm employs in the US.

1. If you are in IT field, you don't even have a grasp of software development lifecycle and the part QA plays in it. A good QA cycle is essential for a good quality product. It is your ignorance about software development cycle that makes you say good QA guys are not an asset for a good product and they are not smart as developers.
A tenth grader with enough common sense can do good software development. India produces lot of people with good common sense and analytical thinking. That is one of the reasons for India's software boom.
IMO if you don't have a patent in your name, you are not high skilled enough.
2. How many consulting companies do you know do charge their candidates for filing H1 ? I haven't come accross any. It is illegal to do that. If someone is doing that, ICE is after them.
3. All I can say is you are as ignorant as some of the anti-immigrants in this country. You haven't seen the real world.Come out of your little world and look around to see the real world.
4. Yes, you are for whatever suits you. What about getting yourself a preferential treatment for H1B visa and GC ? Sounds good ?

teddy the pun "multi-national managers(via L1A)" was intended. if that makes it clear.
anyway, the focus of this thread was about the president's immigration speech. Atleast the speech included the fact that illegal immigration makes a mockery of legal immigration. understood that any solution also must include finding a way on how to handle the undocumented people.
anyway, the speech for now might be just a start or more "kick in the butt" to let the congress know that they need to start work in CIR. when it comes to fruition is anybody's guess.

On other thoughts its very much possible that someone leaked an early version of the Sept 10 VB. However the Sept 10 VB would have undergone revisions and may be different now. Just like the "leaked" USCIS memo on admin fixes some kind soul in DOS "leaked" this older/draft version of the VB out! As we know NOTHING is "leaked" by accident in Washington DC.
It would also mean BIG movement is coming from CY-2011 onwards as DOS is free to apply FB visas and do a quarterly spillover now.

I always loved this board for what it does - especially the Gurus who always spend their precious time giving input to member's queries. Well... this is not query. I just want to vent my frustration, helplessness to fellow friends in this board. In spite of graduating from a reputed univ with a Masters and very good GPA and also having 7 years of professional experience, I am bound to be a slave to my current Employer without any promotions, career growth or anything remote to that for next (God knows how many Decades) several years. ppl who are junior to me in every aspect are growing left and right and are also getting brighter opportunities. I dont care if you guys think I am jealous of them.... But does God really exist ? sorry for wasting your time with this depressing note.
