Hello,
I would like to clarify that this thread is not about discussing IV donations.
Initially I proposed a special fund raising for Recapturing Visa Numbers to pay for the lobbying efforts and all expenses that would incurred by the IV team.
For people who question why money is needed to do these activities, I recommend doing a google search to understand how bills get formulated and passed, on how lobbying works etc. Or they could open a special thread to discuss these things.
Can you imagine how this organization could be run, how the IV team could meet with the lawmakers and USCIS authorities etc. Everybody have their family and work commitments/schedules. Sacrificing your personal time to do something that would benefit an entire community is an exemplary and commendable deed. It is always easy to ask questions or type in few comments from the comfort of one's home. Pursuing a common goal and acting upon it with dedication and sincerity is something else.
Simply put, by making donations we are helping the IV team to achieve our goals in the arena of legal immigration reform. It may not be the most efficient organization in the world, but it has been effective and I have personally benefited by IV's effort since July 2007 and have made regular donations to the IV fund. Of course there would be people like Snathan who would want to kill ideas and proposals. These are to be simply ignored, as we already deal with lot of shit in our lives.
Saralayar, to help generate statistics I have updated my profile with the important dates now. I will update them with more info later on. Thanks.

yup........i wish everyone who used substitute labor, or interfiled EB3 to EB2 should not get their green cards for about 10 more years. May they be screwed by their (mostly) desi (mostly) IT-Software employers.........they deserve every single bit of misfortune for F*$#ING up the chances for every honest EB filer, who patiently waits in the RIGHT queue.

I will sign up ...Since IV has a lot o f $$ requirement now...please make a huge contribution and also sign up for monthly contribution...too many people want a free ride...free ride aint happening any more..only $$ speaks in the commercial capital!..

Really need urgent help on this. These folks are asking me to sign a 1 year contract with them. Wanted to ask if anybody has any experience with this company.
Do they really sue if we break the contract?. Is it legal in the US to have a binding contract to begin with?. Please let me know. I need to make a decision in a few days as I am packing my bags from Texas and flying to Santa Clara to attend their courses...

All this is con artistry about charging for "training". They post ads saying we have urgent business requirements for 5 Analysts but you have to attend our course....once u attend the course, on the very last at 5pm, you'll be given a sheet of paper to sign a contract, which means u have to stick with them whether u get a project or not.
Modus Operandi - If u get a project, they make money............if u don't get a proj, they are not affected since they don't pay on bench...........if u get a proj with another compnay and leave, they sue u and show u ur contract and make money.
Win win for the desi consultant, tough life for you buddy. Make an informed decision. Everyone knows how these ppl operate and still get stuck with them.
I don't want you posting in this same forum 5 months from now that I have been sued or been threatened to be sued and can I shift employers etc as I don't have a project.

I would not agree with the slogans you have proposed. It is important to bring out the same message in a subtle manner. We should not forget that we are trying to get the lawmakers fix the system so it benefits us. But at the same time we should not unknownly take on some one else (Illegal Immigrants).

Hi,
Have a question on my visa.
I applied for H1 visa with company A, when I am in US in Apr'08 with
L1 thats getting expired, due to emergency I went to India.
I got h1 approval notice with COS on July'23 2008.
My Indian company B asked to get fresh L1 , so I took a stamping on
Aug'20 2008 and came to US on L1
changed company A with H1 visa . (company A did not do any COS again, since they say H1 is already with COS).
Want to know if my H1 is valid do I need to do any other things to
tell USCIS that I am on H1 NOW. Can I do stamping at Mexico/Cuba.
If there is any problem above how to come out of it.

Should I send a AC21 letter to USCIS along with my new employment letter?
Who is the best attorney for such cases?
Is it possible that my prevous employer hasn't revoked 140? How can I know that? I have received RFE after one year after filing the case. Is there any way I can know the date when my previous employer did revoke the 140 ( in case he did)?

Your best bet if USCIS let you do the AC-21 switching and use the employment letter from the new EMployer who is sponsoring your H1B visa, if u dont respond to this RFE they may very well deny your I-485, remember the I-485 is dependent for at least 180 days on the underlying I-140 petition filed by the GC sponsoring employer, after 180 days you are free to take new job position in the similar field with same salary mentioned in your approved LC or salary greater than the one on aprroved LC.

there is no concept of employee transfer after 140 approval. once u get 140 approved u can get 3 year incremental h1 extension due to retrogression- portability is also allowed during these 3 years - so u can join any employer. (h1 transfer) also note that if ur current employer does not revoke the 140 u can retain the PD and use it for a new gc application with a new employer, else u must start the LC-140 etc process once again.

Mnay July 07 filers have reported LUDs and RFE on their 485 this past year when their priority dates were not current. This means all the files that were received in or before July 27th 2007 at NSC have already been reviewed.
I'm sure most cases have recd at least a computerized review by now, many of the LUDs are for fingerprinting, name checks, change of processing centers etc. Yes there is definitely activity.
However, it does not mean that all pre Jun06 cut-off cases have been pre-adjudicated.

Guys,
I know ROW country may not like this thread, but look at EB-3 India or China, put yourself in our shoes and than you may realize how unfair this country is. In this unprecedented financial turmoil, I feel there are very remote chances for CIR or any package which increase immigration etc would pass, I am taking this initiative to gather as many people I can and go to washington. Again this is not an IV effort. If you are with me , you can spare some time or few days in Washington, please PM me. our sole agenda is bring a 2 line bill to remove country quota...
Didn't we have these discussions over and over before? and the admins telling us to stop because IV goals are set and will not change?
If you just want to argue and waste time, lookup previous threads discussing this and you'll have enough reading material for weeks to come.

All US senators know that EB immigrants are going through Hell hole of USCIS. They are unable to do anything about it.
Although USCIS does not report to Congress, USCIS merely implement the laws created by 100 Senators and 435 House members. Our anger towards USCIS is mis-directed. The anger and focus should be on the Congress to pass the laws that will fix green card wait time.
All Senators are actors. They pretend that they know our problems but they actually do not do anything to fix our issues. Otherwise, why would this amendment have 70 votes as pappu said in his post.

How many applications are pending for EB-3 (I). ?
Currently the tunnel is closed at the end for EB-3 :mad: and the only way out I see is for us EB-3 folks to dig through. No one cares about EB-3 I folks. That's the way I see it.

All the NJ members - it is very critical that you all attend the rally. As this chapter has been lying dormant for a while, we decided to merge this into the tri state and a lot of NJ members are in the tri state chapter.
