Hi,
My 485 status on USCIS site is showing Document production or Oath Ceremony. The status changed on 7/8/2010. What does this status mean. Does this mean approval? How long does it take to recieve the actual card once the case enters to this state.

Hello There,
Thank you taking time to go through the details.
My green card application is family based and my spouse is a primary applicant. I have a EAD as of now and I recently got laid off on January 15th 2010. My H1B VISA expired on January 23rd 2010.
Issue: I recently applied for Advance parole and got rejected. Reason was given that my I-485 is administratively closed.
My laywer has suggested that I should immediately apply for H4 to save my status. I am really not sure what to do here. I am sure I will find a job in about 2 weeks but not sure if I will be able to get my H1B renewed or will be able to get a new H1B as I have already been counted towards the quota once.
I also read that it depends on the approval of I-130 but in my case I couldn't find I-130 for myself, even though there is one for my spouse which was approved in 2007.
My questions are:
1: What steps should I take to save my immigration status?
2. My EAD is not denied yet, should I start working on EAD or apply for H1B right away?
3. Can my H1B be renewed as it has already expired?
4. I have had a EAD for over a year and all of a sudden it may get canceled. Is there a way I can appeal somewhere as a mistake was made my immigration itself?
5. Have you experienced any cases similiar to mine and what were the outcomes?
Please, let me know your thoughts as your expertise can certainly help me save my career.

Lawyer had just mentioned NA in that column, thankfully, I had submitted copy of my I140 approval.

It's not clear what you really mean.
You say your employer has agreed to file your AOS papers but has not agreed to proceed with the processing. Isn't that one and the same?
Besides you should ask for exactly what the risk is.
Maybe hiring your own immigration attorney or a consult is the best to get your facts straight.

As a July 2007 filer, you do have to pay the $305 filing fee. The $80 biometrics fee applies only to applicants for Reentry Permits and Refugee Travel Documents. It is not required for Advance Parole.
Individuals who file for AOS after July 2007 have to pay a $1010 filing fee for the I-485, but are not required to pay filing fees for subsequent AP's and EAD's. The following is an excerpt from the USCIS website:
"Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms concurrently. If you choose to file the I-765 and/or I-131 separately after July 30, 2007, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence of the filing of an I-485. My fianc� is on a tourist visa and I am on a H1B visa, we are planning to get married while she is on a tourist visa? Is that okay to do so, any restrictions?
Second question After marriage can I convert her visa to H4 dependant visa while she is here, so that she can stay with me without going back? Does she have to go out of the country for this conversion to happen?
Also if she wishes to go out of the US on the tourist visa after we get married can she still apply for a dependant visa H4 to come here ? Will that cause any issues for her?
Which one is better to do, marry and apply for her conversion right away over here or should she go back and apply from outside the country?

My status on I-140 changed to "Request for Additional Evidence". Notice was sent only on 25th, so I don't have any more details yet.

My husband was an Asylee (approved asylum) when he got married to me. But he got the Green card through me. I am a US citizen. Now he wants to apply for Citizenship through me.
when we applied for his Green card he had to renew his passport of his country of citizenship. it was one of the requirements. That country of citizenship was obviously also the county of his persecution. there was absolutely no issue about it at the time of his Green card interview.
But could it be a problem for citizenship interview?
He never traveled to his country of citizenship nor to any other place. He has never left USA ever since he came here. Does his asylum case will again surface at the time of citizenship even when he is applying for citizenship through me?My understanding is that the asylum thing is no more the issue if he got the GC through me??
Your advice, input and suggestions will be highly appreciated.

You would require copy of the approval notice of 140 from the old company.
In the new company, you would need to file a new labor via PERM. Once it is approved, you would need to file a new 140 and use the copy of the old approved 140 to port your priority date.
