Simply going by the voting standpoint, I think between now and 08 elections, politicians will have little incentive do anything about our case (i.e., legal immigration) realistically. I'm not sure whether we represent a % of voter population that's high enough for them to place our case on their priority list. Moreover, giving us GC now will probably benefit them (in terms of votes) at least after 5.5 years once the GC holders are citizens and hence able to vote.
Just my thought for what its worth.

I need advice/thoughts from you on some of the questions below. Any response will be really appreciated.
1. Got my 485 approval and GC (phycical Card) in hand. What is next? Do I need to get a Infopass appointment and get stamped before any abroad travel?
2. Before receiving 485 approval, my wife and kid went on a Vacation(abroad). Their H4 visa expired on passport, but they have h4 extension/approval till 2010? I was thinking of sending them to H4 stamping, but now that I have 485 approval for them, What should I do? Just bring them here and show GC at port of entry? (Ofcourse, I'll take their GC go abroad and bring them back)?
3. Anything i should be aware or concern about these situation?

My wife is currently in the US and since my PD is current we need to file her I-485. We are trying to self file and would like to know what documents do we need to provide to prove that she successfully fullfilled her 2 year home residency requirement (HRR). She left the US in January 15, 2006 and came back on H4 in February 8, 2008.
The fact that she was granted H4 visa implies that she has fullfilled the 2 year HRR but our attorney said that she needs to prove that my wife did indeed fullfill this requirement.
Has anyone been in this position?
Please advise.

Hi Everyone,
For my I-140 (Premium Processing) USCIS's website is showing that they have sent a mail requesting more information on March 27th. Does anyone konw how long it takes to get to the lawyer's office? Para-legal at my lawyer's office told me that it takes about 14 days for that to reach them.
At the same time she told me that they give 30 days (she was not sure) to respond.
Can anyone please confirm this.

- For Perm and subsequently I-140, you can only specify employers that are directly relevant to the number of years of experience claimed in labor. The details of the petitioning employer are most relevant and all your past employments should add up to the experience required
- However, for I-485, which is your application, you have to specify all the employments that you filed taxes for and from whom you received your paystubs (primary/secondary).

Many threads here are on this, you've got to look for it and read. You've asked a question that has been asked and answered many times. That is why nobody has answered your questions.
In brief, you can use AP to come back, and work with H1B for the company who filed your H1B petition, and you can extend or transfer your H1B as well. You can also work on EAD for anyone you want, but you cannot come back to H1B.
There is more on other threads that will make you feel more positive about these answers, and helpful info on traval with AP.

You are correct that if you do not maintain valid H-1 status your wife will lose legal status in the US. If she pursues a degree as a FULL TIME student she can file for a COS to F-1. As part of that application she will have to document her valid H-4 status by proving that you are in valid H-1 status with current paystubs and/or letter confirming your employment from your H-1 employer. So it would be safest to file the COS while you are still employed.

if an earlier original EB3 I-140 is revoked and if EB2 labor is approved now, can the PD be ported while filing new EB2 I-140 provided EB3 I-485 is pending??

I'm not from India but I believe in Karma. We create our own future through our actions. If we perform a good action today we can expect a good result. That is why it is so important that the undecided people attend the rally!
Think of retrogression as Sansara. A vicious circle. It is only by acting and creating our own Karma that we will get out of Maya and see reality. Our gren cards will not fall from the sky, we have to go get them! By not going to Washington and assuming that your green card will suddenly appear out of nowhere, you are proving to yourself that you are stuck in some sort of immigration avidya.
We need to act with selflessness as in Karma Yoga, so that we can understand how our unity will bring the results we seek, to all of us.
Remember Arjuna when he realizes before the battle that his enemies are his own family. We at IV should not be our own enemies by not attending the rally, because we all know what Krishna told Arjuna: "Your duty is to fight"
Instead of hurting each other, we need to use karma and our friendship for each other to unite in our common cause and fight. Remember, our duty is to fight, it is our choice then to fight against each other (by not attending the rally and letting others do it) or fight all together, united against retrogression, and create the good Karma that will ultimately defeat the broken immigration system.
We all are family! Let's fight together friends!!! Come JOIN US IN DC!!!!

Hi! I need a help.. and I mean HELP. Cause my gc is still pending. we (my family & i) are still waiting for it to come and my problem is that I am planning to go back to my country to study college in there.. Classes will start on the first week of June, and i guess that I cannot wait for my green card to come. My questions are:
1. Can I use my H4 visa (that had been issued in US embassy in my country of origin) to leave US?
2. Do I still need to get AP?? Even if I am a dependent of my parent?
3. Incase our (family) GC arrived in our house here in the US, can they just go home in our country of origin with the green card? (my greencard?)
4. Can I use my green card (brought by my parents from US) to enter back to US???

The full story is : The client company, I am working with is processing my GC for future employment. 485 was applied and I received EAD. It has come up that the current employer has an agreement with the client that , the client should not employ any of their employees for 1 yr after the termination. So, I need to quit the current employment, work else where for a year and then join the GC sponsering company.The I140 will not be revoked.
Since I am not currently working for GC sponsring company, does any of the AC21 issues matter ?

yes you can take up employment with C. If you get an RFE at any point within the next 180 days make sure B can give you an employment offer letter. post 180 days you can invoke AC-21 if you want and use C as your GC-Sponsoring employer.
