However, that said, you could have multiple H1 visas and work full-time for one and part-time for the other, as long as the first one doesn't have a problem with it :-)
If you get paid for work in the home country, there may be complications. One being that you'll still be taxed in the US. Consult a good Immigration attorney and a good CPA before doing anything like this.

Gurus,
My H1B extension is pending with the VSC. I want to upgrade my H1B extension to a premium process by paying 1000 USD.
Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?
I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!
Please help.

I am planning to use AC21 to change employers. I signed G28 to allow the attorney for my current employer to represent me before USCIS. Since I signed G28, is it possible for my current employer to withdraw my I-485 application?

Every time I call USCIS to inquire if my I-140 is filled under EB2 or EB3. They ask me to ask my lawyer or employer to call. They won't tell me. I do have a copy of I-140 that states it is Eb2 (Advance degree and all)
I cannot ask my previous enployer to call as I have left the company using AC21.
Please advise what is the solution?
EB2, if your I-140 approval reads as "Section: Mem of Profession w/Adv Deg, or of Exceptn'l Ability Sec.203(b) (2)" You should be worried only if you had two different 140 with the same employer. Take infopass and give a try, there is no standard procedure to find out.

If your name is coorect in EAD, then you should go to SSN office and
explain them , and if required re apply. You will get it changed. Remember SSN is going to be stuck to your lifetime. Hence better do the correct thing.

Now I know there is no formal form for AC-21. Most of the people send a letter along with some supporting documentation that their new job is similar to the old one. I didn't send any such letter, however when my H-1B transfers were done, the attorneys quoted AC-21 in the petition and got 3 year H-1B extensions.
My question is, would that consider notifying USCIS of AC-21, or is the 485 department different from H-1B department?

What format are you saving images in? As I understand from what I've been told (I've shot with a D70, D1, and D200, but not a D100), the D100 can be quite a pain to use with compressed RAW, as it becomes very slow; are you sure the settings haven't somehow gotten changed to use RAW compression?

Other gurus can answer in a detailed manner. I am going to very short. Chinese Eb3 have filed for an injunction stating that they need to be allocated visa numbers because in 2008 and 2009 they were overlooked because DOS could not count the inventory of EB3 properly.
DOS replied that this kind of injunction would harm other countries ppl. DOS is allowed by law to make reasonable estimates in progressing and degressing priority dates. If some ppl are left behind they cannot do anything.
Here is the part of the law which states that DOS has the authority to do reasonable estimates of priority dates and this is what was stated in the DOS response to the injunction
Congress has expressly
provided that in allocating visa numbers, the Department of State may “make reasonable
estimates.” 8 U.S.C. � 1153(g). In relevant part, Section 1153(g) states:
For purposes of carrying out the Secretary’s responsibilities in the orderly administration
of this section, the Secretary may make reasonable estimates of the anticipated number of
visas to be issued during any quarter of any fiscal year . . . and to rely upon such estimates
in authorizing the issuances of visas.

You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...
Cheer up...

I am travelling in June to India, during that trip I have to stamp my H1B visa at Mumbai or Delhi. Does any one has a recent experience at Mumbai consulate about visa interview? Does anyone knows current acceptance percentage at Mumbai or delhi consulate? Is it safer to travel in the economic crisis?
At the same time I have heard some rumors regarding rejection at Port of Entry is that true. Anyone from this group has faced such situation?

Hi Everyone,

When I tried to apply for SSN i was told that the names has to match with the name written in I-94 at the port of entry and the person said that I have no other option to change the name so I agreed upon the name which on SSN . Now I googled out and came to know that I can change the name in port of entry . It would be of great help for me if any one can help me out getting out of this situation .

Per lawyer, almost all EB2 cases are being audited (due to the harsh economic climate). DOL believes that if a job falls under Job Zone 5, then it requires enough preparation to justify a EB2 filing. If it falls under Job Zone 4, it's not "normal" and DOL would usually require a Business necessity letter.
