My friend is filing for student visa(for masters) as her H1B is about to expire in september(already has 6 years on it). She has worked on different projects and even had part-time jobs but she couldnt find a company that can sponsor her H1b. She was also jobless for an year(last)...long story.....anyways.. She lives with her family but her parents cannot help her much cuz their green card application is still in process but she is above 35 yrs old. Now she cannot think of how to answer these questions on F1-Visa.
-Describe the events that led to your decision to study in the U.S.
�Describe your intention concerning departure from the U.S.
�Show evidence that establishes that you have a residence abroad to which you intend to return
She is from Pakistan and althu she has relatives there and plus her parents own a house(proof of her resident in PK that she can return to) too but you know how the situation is there and she wants to live with her parents. So how should she answer the above questions?

Does any one know how a company from a foreign country(India) can open a bank account in USA.
There is a possibility to register as a company in US and then apply for business account. But being still on H1 dont feel comfortable to register a company in US.
Are there any other ways a company in foreign country can open an account in USA to do the business at least to get the payments from the US customers.
Are there any suggestions to specific banks like wells fargo or so that would help in the process?
How about credit unions like DCU? Do they offer such provisions?
Any thoughts on this would be greatly appreciated..

The Kentucky Consular Center in Williamsburg, Kentucky has registered and notified the winners of the DV-2010 diversity lottery. The diversity lottery was conducted under the terms of section 203(c) of the Immigration and Nationality Act and makes available *50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States.
Winners should start finding out very soon. Notifications to the randomly-selected diversity visa or "green card lottery" winners are being sent between May and July 2010.
How does it all work?
Soon an official letter from the U.S. Department of State Kentucky Consular Center (KCC) in Williamsburg, Kentucky will be sent to the mailing address that you provided in your entry. Being selected as a lottery winner does not guarantee that you will receive a visa; you must still apply and qualify for the immigrant visa. The notification letters will provide further instructions, including information on additional forms and documentation required and immigrant visa application fees.
Only participants in the DV-2010 program who were selected for further processing have been notified. Those who have not received notification were not selected. My birth was regiestered under totally different first name, also DOB is off by 9 days (10th June instead of 1st June). Since the birth is registered they are not issueing non-availability cert. . What to do?
I have both parents affidavits, school leaving cert, 10th class cert, PAN card showing date/place same as that in passport. Filing a civil case in India is the option but it could take more than a year. since my PD is Sep04, my 485 could be processed within months.

Anyone of you who has been fingerprinted and had interview with USCIS,
How long did you take to be given a schedued appointment for interview after the fingerprint? Did you have an interview right after the fingerprint?
Is that possible to have it both on the same day?
I am asking you because I would like to travel outside of the country with AP as soon as I have my fingerprint done.
If I would be nortified of the interview date right after the figerprint, I would rather stay to finish everything before travel. That way, I won't cause any troubles, right?

Last October I hired a lawyer for an AOS ( I-485 ) and the I-130 and I-131 forms.
Obviously I did it because I did not have any knowledge about immigration matters.
In Novembre 2007 he did contact me telling me I needed the I-765 form to legally work in the country, so I did fill the form sending it in his office by mail.
He told me he sent the form in the first week of December 2007.
Ok now this is the situation :
I never get by mail the notice of action about the form I-765 and what concern me the most is that I still did not get the permit to work.
I periodically check the processing time cases from the USCIS' website, and I have seen that USCIS (NEW YORK area ) already processed the I-765 forms for the complete month of December, does anyone know if Uscis is having problem processing EADs....I am really worried that something did not go through... probably it's just normal to have so many questions but recently I think about that all the time.
Oh guys one more thing...I paid this lawyer thousand and thousand of dollars.
I realized reading the USCIS website that if you fill the form I-485 you are not required to pay the $ 340 fee for the I-765 form . Last November he asked me to send him a check for the EAD fee. When I told him that last time i spoke with him by phone he said he did know that , then he told me that he just had moved from his old office to a new one so my case was in storage, in storage ?? My case is still pending and he put it in storage, i am so disappointed ...unbelievable this lack of professionality.
I should have do it by myself at least now I would have money to buy a nice used car.

His wife's GC is through his and her stay here depends on him.
So don't go for the route, to file for him as her depenant. This will make everything screwup.

u cannot use Canada PR to enter US. If he left US without AP then his application for adjustment of status is considered abandoned.

I think someone has given you incorrect information.
A visitor can stay for a maximum of 6 months (180 days - unless person is given earlier date in I-94, which is not usual) At a stretch. If person returns before 180 days, he/she can come back within a day and get a new I-94 and again can stay for 6 months (180 days or the date written on new I-94).
So, person's stay is not governed by number of days in a year, but by the date which is written on I-94. As long as she gets new I-94 with new date, she can stay until that date.
As a side note, what you are confusing with is the tax requirements, which is: If you are claiming a person to be your dependent, he/she must have stayed in the country for atleast 6 months in a calendar year.

I hear that any transfer of a visa to a different one, in your case from L1 to H1 need to go back to your home country for stamping. Please consult an immigration laywer for more details.

* Employer A = Previous Employer with whom I have my I-140 approved
* Employer B = Current Employer. I do not have a PERM or I-140 approved with this employer. I used my I-140 with Emp.A to get a 3 year extension when I transferred from Emp.A to Emp.B [So now, due to this extension, I have my H1-B approved upto Aug'08 instead of June 2006, which was the end of my H1-B six years]
* Employer C = Future Employer. I am planning to move from Emp.B and join this Employer now.

I am a computer science graduate from India ( 4 year engineering degree course) with 3 years experince in SAP. A reputed company in US has agreed to process H1 for me. They have only asked for my educational certificates. My experience certificates were not submitted since they said it is required only when you go for the H1B at the US Embassy.
My query is wheather experince certificates are required for applying H1B.
