My wife is currently in the US and since my PD is current we need to file her I-485. We are trying to self file and would like to know what documents do we need to provide to prove that she successfully fullfilled her 2 year home residency requirement (HRR). She left the US in January 15, 2006 and came back on H4 in February 8, 2008.
The fact that she was granted H4 visa implies that she has fullfilled the 2 year HRR but our attorney said that she needs to prove that my wife did indeed fullfill this requirement.
Has anyone been in this position?
Please advise.

Comprehensive immigration under Democrats did not have anything for us as high skilled immigrants anyways. With a decrease in EB visa numbers in fact it was anti high skilled immigrants.
In fact the IV community was rejoicing when it fell through in the senate.
Now that CIR has been pushed ahead, IV can easily put forth the perspective of having a legislation specifically for the skilled community.
Lets look at it this way, CIR was an excuse used by a lot of politicians to avoid solving issues faced by the highly skilled community; with its demise they have one less excuse.
In fact the IV community was rejoicing when it fell through in the senate.

Hello,
My husband and I got married in December 2008 while I was a tourist in the United States. In order to stay and live with him, I sent an I-485 application with all the package (I-131, I-765, I-693...).
I have received 2 advanced paroles and my work authorization and will have a SSN in proably 2 weeks but the green card, if accepted, will come very late.
Now I really would like to visit my family and friends in Belgium for Christmas (or later, regarding to the job I will have) and I have heard that the advanced parole will not help me a whole lot.
So my questions are:
- Who should I contact to be sure that my husband and myself can go visit my family without any problem at the border, I mean, with the certitude I can come back in Pennsylvania with my husband? The customer service is not really helpfull this time.
- Can I do it at all without beginning everything from the beginning and restarting all the immigration procedure?
- What and to whom do I need to proove that I don't do anything bad and that I just want to visit my family and friends?
- What kind of documents do I need to take with me? What kind of forms do I have to send to USCIS or DHS?
I know it's not a question of life or death and there are a lot more urgent problems for other people, but I psychologically need to visit them and present my husband to some of my friends.
Could you please help me? Thank you.

Yes you can apply for EAD and AP separetly anytime
The only catch I found out recently is that when you use AP to travel back to US, this may invalidate the H visa and you will need EAD.
I am still not clear of this issue. I applied for EAD few months ago and found out this may be an issue , so have applied for AP (By e-filing) now
Using AP to travel does not invalidate the H1...AP is just a travel document, and does not determine one's status in the country. The H1 would be invalidated only if the person switches to EAD.

It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic. If you file the extension before expiry of the current I-94, you will be OK. It can be approved even after the expiry. She will be considered to be legally present without gap, if extension is granted.

The booth has been booked and the menu has been finalized. All we need now is an enthusiastic bunch of volunteers who can help raise some funds for IV.
Since this is our first time doing a food event, we are trying to keep our goals modest and hope to raise around $400.
It would help if any of you have any experience and can share your tips with us.
Hoping to have lots more volunteers!
