EAD Applied : Oct 9, 2008
Card production ordered : Nov 17, 2008 (Not yet recieved)
Approval notice sent :Nov 26, 2008 (Not yet recieved)

You can get the visa the same day, no appointment required. You will need to be there early in the morning

All this while EB suffers.
An illegal is still going to do a $8/hr job, whether you give him a green card or not. He is still not going to pay taxes because he will get paid in cash. All that will change is that the illegal will be able to send sponsorship for his 50,000 cousins and uncles.
EB will continue to suffer..as always.

I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. NOW IF I GET FULL TIME JOB WITH OTHER EMPLOYER (other field)AND IF I WORK LESS HOURS (means I get under pay than showed in labor) WITH SPONSORING EMPLOYER, WILL I BE IN TROUBLE? The fingerprinting is generally scheduled to give enough time to the personnel at the center to do their job comfortably and not have a large waiting line. From my experience I found that the scheduling is loose and so the folks at the centers can accomodate an extra person very easily. Also these are contractors who get paid by the number of cases so they are okay with doing a fingerprinting if you turn up on an unscheduled day.
The best bet is to turn up on a weekday. I did this for both myself and my wife as we were headed to India the day our fingerprinting was scheduled. There was no one in line and the whole process took at most 10 minutes.

While filling the I-94 arrival record, My Friend did not give his last name at all . There was only two fields he filled 1. Given/First Name & 2. Date of Birth only.
So the I-94 record does not have his Family (Last) Name.
Is there any other center available so that he can give his last name for I-94 or he has to file the form I-102 (the disadvantage for filing the form is he has to send the original I-94 along with $320)

Previous company:
Perm PD: June 2006 EB2
I-140 EB2 approved in Nov/2006.

trying to recapture the old PD of June/2006.
Today, when I checked my I-140 status, it says "Request for Evidence sent" yesterday.

Is there any risk in rescheduling a fingerprinting appt? I am travelling when the appointment is currently scheduled for:(. Does that impact the overall processing times of 485/EAD/AP?
I don't know how it affects the overall processing times, but there is no problem rescheduling the appointment. Just follow the instructions on your notice.
1 disclaimer - you MUST reschedule it before your original appointment date. Failure to attend your appointment without 1st rescheduling is considered an abandonment of your AOS etc.

I have been working for Company A which was bought under the Umbrella of a bigger parent. My company A still operates under the same name and is fairly independent.
The parent company bought another company B recently and have asked me move to B for business reasons in a similar role as with company A. Could I file a new GC with B and use my 10+ years experience with A to file for under EB2. I am currently under EB3-I category

well if there's a way for you to get your approved labor certification doc, or even the copy of the filed labor application; then definitely get it.
The labor app has the exact job description too. So if you do use portability (ac-21) it'll help to match it with the job specs of the new position.

My Case Details:
I currently have an H1 and have applied for 485(in July 2007, EB3 India, priority date April 2004, I-140 Approved, EAD approved). My wife also applied 485 (as beneficiary dependent) along with me and is currently working on EAD. Unfortunately my daughter was not in the country in July 2007 and due to unavoidable reasons she was not able to apply for 485 then. She came to US on H4 dependent visa and is currently studying in public school.
My H1B visa and my daughters H4 visa expires in Sept, 2010. I want to use my EAD in case if my H1B extension is not approved in Sept, 2010 and am trying to find out if there were other legal ways for me to have my daughter documented in US.
One of the option I was considering is try to get a F1 Student visa for her. My Daughter is in 10th grade currently (15 years old).
Please advice:
- What would be the best independent status for my daughter ?
- if My daughter converts to a student visa (F1), and some time later EB3 category becomes current for my priority date, then can 485 be applied for my daughter while she is in F1 status ? IN other words are there any issues of her being in non-immigrant intent F1 visa and me applying for 485 for her as my dependent ?
- Is there any limit on the number of years a person can be on F1 Visa in US ? She is currently in 10th grade and might join 11th Grade in F1 visa.
- Does she need to go out of US to change her status from H4 to F1 ?
- In case if required can I convert my EAD status back to H1B ?

As far as I know, any person can stay in US legally only on one visa at any point of time. That said, the moment you switched to L1, your H1 is invalid. I'm pretty sure that you can't use your previous H1 extension and you have to file for new H1 petition which starts in April 2008.

Just read that if you have sent one check for 1-140 & 485 then the whole package will be returned and you would have to refile your I140. If you have sent separate checks then they will just return the I485 part of your package.
