Yes there is. I paid for mine and got approval in 10 days. I did that because I did not want to wait.

Yes, you can return to the US with the same visa, as long as you are employed with the H-1B petitioner. It is better if you have some documentation about projects etc. There is no need to furnish pay stubs for the time you spent outside of US.

Employment Letter is a part of the initial evidence. There is a memo recently saying that any missing initial evidence will result in denial of application without RFE. Try to cajole your employer and gather as much evidence as you can about being asked for $$$ for helping you file 485

You cannot claim a cousin on F1 status to be your dependent.
The most important point is F1 students have to file their own 1040NR and are Non resident aliens for tax purposes and cannot be dependents on Resident alients.
More over You cannot claim the tuition deduction for her because
(1) she showed proof of financial ability when joined the school.
(2) AFAIK, Tuition deduction can be made only for people either you/your spouse or your dependents
I know this because I paid tuition for my own sister and I was told that I cannot claim her as a dependent. Some CPA might say the contrary, but if you want the exact info call the IRS 800 829 1040

can a medical assistant be eligible for H1 visa. I have a sponsor but we dont know whether medical assistant job is eligible for a H1 visa. Please let me know if this is possible. I am a medical school graduate. the hospital is a private practice. I am currently on student visa(I-20).

The only answer to your question is:"it depends". Who are your state's Senators and how interested/influential are they in immigration issues? Same question for whoever is the Congressperson for your district. I don't think any there is any harm in contacting both Senators as well as the Congressperson for your district.

My cousin is getting married to a US citizen in February 2009. I want to get information about K3 visa for spouse of US citizen. My questions are:
1. I have heard that it takes long time to get K3 visa, is that true?
2. If the above statement is true then what other visa option is best for her, visitor or fiance visa (K1 visa)?
3. Is it necessary that immigrant visa petition (greencard) is in process before applying for K3 visa?

Hi guys,
We have been trying to talk to somebody consequential at the US Embassy in New Delhi because of a medical emergency. My wife and son both are in India. My son, who is a US citizen requires immediate medical assistance in US. Unfortunately, my wife does not have any visa at this moment because of some technicalities.
We are trying to contact somebody from the embassy staff who can assist us in getting an emergency visa appointment. we tried to call the numbers given on their website, but we are only able to reach low level operators who simply redirect us to another automatic voice mail number. Also, writing to their email address is not proving anymore helpful. Mostly we don't even get any reply to our emails. Sometimes we simply get some automatic response to our emails which is not at all relevant to our requests.
So if anybody has any direct number/email of some senior embassy staff, please forward it to us. It will be really helpful for us.

As I interpret what you said If she comes back on H4 her H1 (i797) invalidates?
Yes, she can not work until she files another h4-h1 (cos) - you will not be subject to cap, you can do that any time after she enters.
